Convention
on the Means of Prohibiting and Preventing the Illicit Import, Export
and Transfer of Ownership of Cultural Property (Paris, 14 November
1970) - Withdrawal of territorial declaration by Denmark
By LA/DEP/2003/012,
UNESCO informed you that, on 26 March 2003, Denmark deposited with
the Director-General its instrument of ratification of the above-mentioned
Convention. The instrument contained the following “temporary
reservation” which read as follows:
" … until further decision, the Convention will
apply neither to the Feroe Islands nor to Groenland" [original
: French].
By LA/DEP/2004/014,
UNESCO informed you that, on 27 May 2004, with regard to the above
declaration, Denmark informed the Director-General that:
“…the Greenland Home Rule authorities have expressed
the wish that Greenland be covered by the said Convention. Denmark
therefore withdraws its declaration made upon ratification of the
Convention to the effect that until further notice the Convention
should not apply to Greenland.”
The UNESCO Secretariat then requested a clarification concerning
the terminology used, and on 19 August 2004, Denmark informed the
Secretariat that the above-mentioned “declaration” (which
had been termed a “temporary reservation” previously)
should be described as a “territorial declaration”.
On 17 April 2008, with regard to the above territorial declaration
made upon ratification, Denmark informed the Director-General that:
“ …the Government of the Faroes has expressed the
wish that the Faroes be covered by the said convention. Denmark
therefore withdraws its temporary reservation made upon ratification
of the Convention to the effect that until further notice the Convention
should not apply to the Faroes.”
