- Cultural
Heritage Laws Database
In 2003, UNESCO devised an international solution to combat the
illicit traffic of cultural property: the Cultural Heritage Laws
Database. By compiling on the Internet the national laws of its
Member States, UNESCO offers all stakeholders involved (Governments,
customs officials, art dealers, organizations, lawyers, buyers
and so forth) a complete and easily accessible source of information.
In the event of a legal question about the origin of an object
(which may have been stolen, pillaged, or illegally exported,
imported or acquired), it is useful to have rapid access to the
relevant national laws.

- Prevention
campaign: Illegal traffic of Cultural properties (Argentina)
In order to increase awareness on the importance of protecting
the Argentine cultural heritage, the national Secretariat of Culture
implements, from December 2006, the Campaign against Illegal Traffic
of Cultural property. The prevention and fight against illegal
traffic of cultural property is a task that requires the work
and joint effort of official and private organisms who, by their
nature and competence, provide knowledge and tools that favorably
affect the preservation and defense of the cultural heritage.
The loss of the cultural property affects all the sectors of the
population, as it strips of its collective cultural inheritance
without distinction. Fighting sacking and illegal traffic of cultural
property it is, therefore, a right whose exercise is only possible
with the commitment and participation of all the community.

Art,
Cultural Heritage, and the Law: Cases and Materials (Carolina Academic
Press Law Casebook)
Art, Cultural Heritage, and the Law is one of the first legal casebooks
to address the rapidly emerging fields of art and cultural heritage
law, utilizing an interdisciplinary approach. This book addresses
artists' rights (freedom of expression, copyright, moral rights and
rights in architectural works and historic preservation); the functioning
of the art market (dealers and auction houses, warranties of quality
and authenticity, transfer of title and recovery of stolen art works,
and the role of museums), and finally cultural heritage (the fate
of art works and cultural objects in time of war, the international
trade in art works and cultural objects, the archaeological and underwater
heritage of the United States, and indigenous cultures, focusing on
restitution of Native American cultural objects and human remains,
and appropriation of indigenous culture). |
